A judge who refuses to hear a case and demands the plaintiff dismiss the case, with prejudice , as was Judge Smith 's request of Toray , considers the case frivolous and should grant the defendant Summary Judgement .  If a Judge does not grant Summary Judgement, as was my case, then the Judge should offer the defendant the right to a fair trial.  If not, it appears the Judge is biased against the defendant, and for the plaintiff.
