Bullying can cost United States' organizations as much as $14K per employee per year in lost performance.

In June 2018, Paknis and Toray went to mediation to resolve potential claims arising from his termination. At that time, Toray learned that Paknis had signed a contract to write “Successful Leaders Aren’t Bullies” during his leave. In an agreement to release each other from liability, Toray and Paknis included a nondisparagement clause specifically addressing the book. Non disclosure agreements, like the one I willingly signed with Toray because I knew Toray and its employees were not mentioned or defamed in my book, are often used to silence bad behavior and the truth.  The earliest uses of NDAs began in the 1940s in the context of maritime law. Later, the agreements became popular with technology industry firms looking to protect trade secrets, new products, and proprietary algorithms.
