September 25, 2018, my book, "Successful Leaders Aren't Bullies," is released and distributed worldwide by publishing giant, Simon & Schuster.
On December 12, 2018, Toray Plastics America (TPA) of North Kingstown, RI sued me and, ironically, put themselves and this case in the public domain.
They falsely claimed a common reader could identify TPA in my book. I looked forward to having the truth prove TPA wrong in front of a jury of my peers.
Denied my US Constitutional Rights to Free Speech and to a Fair Jury Trial, I plead with you, my social media audience, to publicize this story.
I also encourage you and those you know to seek the truth about my book.
Can TPA, as they claimed, be identified by a common reader (someone who has no knowledge of Toray's inner workings) in my book, "Successful Leaders Aren't Bullies?"
In US Federal Court, it is pretty routine to have a case set for trial within twelve (12) to eighteen (18) months of filing.
51 months, or more than 4 YEARS AFTER Toray filed their case against me, TPA, on March 17, 2023, agreed, under influence from RI Federal Judge William E. Smith, to dismiss the case, with prejudice, and to pay all my legal fees. I signed or agreed to nothing, so I am exercising my constitutional rights to share the truth about this case.
William E. Smith, paradoxically, had agreed to hear the case in August of 2022 despite Toray not being mentioned anywhere in the book. He then delayed the hearing until March 2023 when he demanded the case not be heard in court.
Coincidentally, Judge Smith and the Magistrate assigned to my case, Patricia A. Sullivan, had practiced law together at a RI firm before being appointed to RI's Federal Bench.
There is likelihood their former firm, one of RI's largest law firms, served TPA, one of RI's largest employers, as a client.
Also coincidentally, TPA's counsel in their case against me clerked for Magistrate Sullivan. Smith, Sullivan, and Toray's counsel did not recuse themselves. This information about their prior relationships was never disclosed.
So, why do you think my 1st Amendment Right to Free Speech (to sell my book) and my 6th Amendment right to a fair trial (to have my trial heard by a jury of my peers within a reasonable time frame) were violated?
